I Hezekiah Owens, Sr. being of sound mind and memory do make, publish, and declare the following to be my last will and testament in words and figures as follow;

Item One I desire that my Executor herein after named shall, out of the first moneys coming into their hands belonging to my estate, pay off all my indebtness including my burial expenses, and place a suitable tombstone at my head.

Item Two I give to my beloved wife Martha Jane Owens, all of my property of whatever kind and description for and during the term of her natural life.

Item Three I give to m three sons, Ellis Owens, W. H. Owens and H. G. Owens all of my real estate, after the death of my wife, in fee simple, the same to be equally divided between them, and charging them that they should pay Hezekiah Owens Jr., Ann Elizabeth Griggs, Janie Midgette, Ruth Sawyer each three hundred dollars within twelve months after the death of my wife, the same to be charged upon my real estate until paid.

Item Four If any of my heirs should attempt to contest or set aside my will, it is my will he or she shall have only the sum of five dollars.

Item Five I give to my four grand children, Janie Owens, Virginia Owens, Lena Mae Owens, and Belinda Sawyer, each five dollars to be paid within ninety days after my death.

Item Six At the death of my wife I give all of my farming utensils, mules and hogs to my three sons Ellis Owens, W. H. Owens and H. G. Owens and all the rest of my personal property of every kind and description I desire to be equally divided between my other four children.

Item Seven I nominate, constitute and appoint my three sons Ellis Owens, W. H. Owens and H. G. Owens my Executors in this my last will and testament that they shall execute the same without having to give bond.

Item Eight I hereby revoke any and all other wills herefore made by me.

In testimony whereof I do hereunto set my hand and seal, this fourth day of October 1927.

Signed sealed published and declared b the said Hezekiah Owens Sr. to be his last will and testament in the presence of us who at his request and in his presence and in the presence of each other, hereby subscribe our names as witnesses thereto.
