Adam Owens to Joshua Gard

North Carolina, Tyrrell County - To all to whom these present shall come
greeting know ye that I Adam Owens of county and province afsd
planter, for and in consideration of the sum of twenty pounds current
money of this province to me in hand paid by Joshua Gard of the
county and province afsd planter have given granted bargained and sold
and by these presents do fully freely clearly and absolutely give grant
bargain sell alien enfeoff release convey confirm assign transfer and
set over unto him the said Joshua Gard his heirs executors
administrators and assigns forever a certain tract or parcel of land
containing by estimation fifty acres more or less lying and being in the
county and province afsd on the east side of Alligator River beginning
at a beach about 10 poles along a line formerly belonging to George
Whidbey thence along his line S 40° E 46 to a pine then S 67° E
166 poles to a pine then NE to the given line then down the given line
to the sound then the various courses of the sound to the first station
it being part or a tract of land patent by John Mixon for two
hundred and ten acres by grant bearing date the 29 th of September 1775.
Reference thereunto being had will more fully appear. To have and to
hold the afsd tract of land with all and singular the rights privileges
commodities hereditaments appurtenance and apparatus hereunto belonging
or in any wise appertain unto him the said Joshua Guard his heirs
and assigns forever in as full and ample manner to all intents and
purposes as the most learned in the law can devise free from all manner
of incumbrances whatsoever, The conditions an provisions of the Lords
Grants only excepted unto him the said Joshua Gard his heirs and assigns
forever, further I the said Adam Owens for myself my heirs
executors administrators and assigns forever do convey and agree to and
with the said Joshua Gard his heirs and assigns that the said
bargained premises and every part thereof is free and clear from the
lawful claim and demand of me the said Adam Owens my heirs
executors administrators or assigns there of is free and clear form
lawful claim and demand of me the said Adam Owens my heirs
executors administrators or assigns also from the claim and demand of
all and every other person or persons whatsoever claiming from by or
under me my heirs executors administrator or assigns or any or either of
them. In witness where of I the said Adam Owens have hereunto set
my hand and fixed my seal this third day of May anno Domini, one
thousand seven hundred and seventy three.

Received this third day of May one thousand seven hundred and seventy
three the whole and entire quantity of fifty thousand good merchantable
eighteen inch shingles being the sum that was due for the within
bargained premises, I say recd by me.
Proved in open court by oath of Thomas Owens and ordered to be
registered, Edward Buncombe Clk.
